As an upstart, we want to provide transparent and fair Terms of Service for our Users.

Our Terms of Service outline the rules and guidelines for the use of our application, ensuring a clear understanding of the relationship between Users and Carpoolin.

These Terms of Service ("Terms") govern your use of Carpoolin mobile application, owned and operated by Save Man Limited ("we," "us," or "our").

By accessing or using Carpoolin, you agree to be bound by these Terms.
If you disagree with any part of these Terms, do not access or use Carpoolin.

 

1. Carpoolin Platform

Save Man Limited acts solely as a technological platform to connect Users willing to share a ride.

We do not provide transportation services, we do not act as a carrier, and we do not employ the Drivers. We have no control over the quality, timing, legality, failure to provide, or any other aspect whatsoever of the transportation services.

​

2. Use of the App

• You must be at least 18 years old to use Carpoolin.

• You agree to use Carpoolin only for lawful purposes and in compliance with New Zealand law.

• You may not use Carpoolin in any manner that could damage, disable, overburden, or impair the functionality of Carpoolin.

• You may not attempt to gain unauthorised access to any portion or feature of Carpoolin.

• You agree to indemnify, defend, and hold harmless Save Man Limited, its officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your violation of these Terms or your use of the App.

3. Cost-Sharing & No-Profit Warranty

Non-Commercial Use & Cost-Sharing Carpoolin is strictly for non-profit cost-sharing.

 

By using the App, Drivers warrant that any payments or "fuel/parking contributions" requested from Passengers do not exceed the actual running costs of the trip (e.g., fuel, tolls, and wear-and-tear).

Drivers must not use the Platform to generate a profit or operate a commercial transport service.

 

Carpoolin reserves the right to suspend or terminate any account suspected of seeking commercial gain.

 

4. User Accounts

• While we may implement certain verification features (e.g., phone verification), we do not guarantee the identity, background, or driving ability of any User.
  Users are responsible for using their own judgment when sharing a ride.

• Carpoolin requires you to create an account. You agree to provide accurate and complete information when creating an account.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You agree to notify us immediately of any unauthorised use of your account or any other breach of security.

• Drivers represent and warrant that they possess a valid driver’s license, a registered vehicle, and valid motor vehicle insurance that covers carpooling activities.
  It is the Driver’s sole responsibility to ensure their insurance policy is not voided by using this App.

 

5. Safety and Conduct

• You affirm that you will not use Carpoolin for any purpose intended to harm, injure, or otherwise negatively impact any person.

• Any use of this App with the intent to cause harm is strictly prohibited and will result in immediate termination of your account and potential legal action.

• You agree to make a concerted effort to ensure the safety of yourself and others while using Carpoolin. This includes, but is not limited to, reporting any suspicious or harmful activities, complying with all relevant laws and regulations, and respecting the rights and well-being of other Users.

• Your interactions with other Users are solely between you and such Users. You agree that Save Man Limited will not be responsible for any loss, damage, injury, or dispute resulting from these interactions.
  You enter vehicles and transport others at your own risk.

 

6. Corporate & Private Groups

Access to dedicated groups is a privilege, not a right.

• Eligibility: Access to these groups is contingent on your current employment or membership status with the relevant organisation.

• Revocation: If you leave the organisation, you must leave the group.
  Carpoolin and Group Administrators reserve the right to remove any User from a private group at any time, without notice, to maintain the security and privacy of that community.

• Data Privacy: Information shared within a private group (such as trip start/end points) is visible to the public.
  Users are encouraged to use public meeting points for added safety.

7. Fees, Payments and Disputes

Carpoolin facilitates cost-sharing between Drivers and Passengers.

We are not a party to the financial transaction between Users.

​

• For payments processed through the App, Carpoolin may collect a service fee of less than 5% to cover transaction and platform costs.This fee is non-refundable.

• Carpoolin acts solely as an intermediary and is not liable for any cancellation, no-show, late cancellation, or failure to pay by any User.
  In the event of a dispute (including missed rides or late cancellations), Drivers and Passengers are expected to resolve the matter directly between themselves.

• Carpoolin reserves the right, at its sole discretion, to issue a refund or credit where a verified technical error has occurred within the platform.

 

8. Intellectual Property

• Carpoolin and its original content, features, and functionality are owned by Save Man Limited and are protected by international copyright, trade secrets, and other intellectual property.

• You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Carpoolin.

9. Disclaimer of Warranties

• Carpoolin is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the availability, reliability, or accuracy of the App.

• We disclaim all warranties, express or implied, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement.

• Nothing in these Terms is intended to exclude or limit any rights you may have under the New Zealand Consumer Guarantees Act 1993, except where you are using the App for business purposes, in which case the provisions of that Act shall not apply.

 

10. Limitation of Liability & User Risk

Carpoolin is a matching platform, not a transport provider.
We do not employ Drivers, own vehicles, or direct the routes taken by Users.

• Assumption of Risk: You acknowledge that carpooling involves traveling with individuals you may not know. You assume all risks associated with your use of the Platform.

• No Liability: To the maximum extent permitted by New Zealand law, Save Man Limited (Carpoolin) shall not be liable for any injury, property damage, loss of life, or financial loss arising from a ride facilitated through the App.

• Verification Disclaimer: While we provide "Verified" badges, these indicate only that a User has confirmed their contact details.
  A verification badge does not constitute a background check, a guarantee of safety, or an endorsement of a User’s driving ability.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New Zealand.
 

Both parties submit to the non-exclusive jurisdiction of the New Zealand courts for any disputes arising out of these terms.

12. Changes to these Terms

We reserve the right to update or change these Terms at any time without prior notice.

 

Any changes will be effective immediately upon posting the updated Terms on the App.

Your continued use of the App after any changes to these Terms constitutes acceptance of those changes.
